Fed. Circ. Upholds Newegg-Overstock Patent Win Over Alcatel

Law360, New York (May 15, 2013, 4:34 PM EDT) -- The Federal Circuit on Wednesday refused to revive Alcatel-Lucent USA Inc.'s e-commerce patent suit against Overstock.com Inc. and Newegg.com Inc., affirming that the online retailers didn't infringe the patents and that one was invalid.

Without issuing an opinion, the appeals court let stand an October 2011 jury verdict that found Overstock and Newegg hadn't infringed Alcatel's three e-commerce patents, one of which the jurors said was anticipated and obvious.

Notably, Overstock and Newegg were the only two companies to take the allegations to a jury. Co-defendants Zappos.com Inc., Sears Holding Corp., Intuit Inc., Amazon.com Inc., Kmart Corp., QVC Inc., Netflix Inc....
