Papa John's Can't Escape Text Spam Suit

Law360, New York (May 15, 2013, 7:16 PM EDT) -- A Virginia federal judge on Wednesday denied summary judgment to Papa John's International Inc. in a suit accusing the pizza giant of sending spam text messages to consumers, saying the plaintiffs have provided sufficient evidence for the case to proceed.

In denying summary judgment to Papa John's, U.S. District Judge Mark S. Davis said that plaintiffs Eileen and William Downing can continue their suit accusing the pizza maker of sending them unsolicited text messages promoting its products in violation of the Telephone Consumer Protection Act....
