5th Circ. Affirms $44M Wellogix Jury Award In IP Fight

By Ciaran McEvoy (May 15, 2013, 5:54 PM EDT) -- The Fifth Circuit on Wednesday upheld a judgment against Accenture LLP for allegedly misappropriating the trade secrets of Wellogix Inc. by excluding it from developing and pitching new software requested by BP America Inc., ruling there was sufficient evidence to support a finding that Accenture acted with malice.

In a unanimous 25-page decision, a three-judge federal appellate panel also ruled that "Wellogix presented sufficient evidence and testimony to support the jury's finding that Wellogix's technology contained trade secrets."
