Lender Asks 2nd Circ. To Revive Allen Family Forgery Suit

Law360, New York (May 16, 2013, 10:22 PM EDT) -- A lending company on Thursday asked the Second Circuit to reopen a lawsuit against the head of investment firm Allen & Co., who allegedly conspired to forge a family member’s signature to hold up collection of a $25 million court judgment.

A suit Excelsior Capital LLC brought over forgery allegedly aided by Herbert A. Allen, a prominent member of a family known for its clout on Wall Street, was thrown out too quickly, a lawyer for the company said at oral arguments in Manhattan.
