Motorola FMLA Suit Not Totally Out Of Line: 7th Circuit

Law360, New York (January 15, 2008, 12:00 AM EST) -- A federal appeals court has reversed part of a lower court's dismissal of a lawsuit brought by Motorola Inc. employees alleging their supervisors violated the Family and Medical Leave Act.

A three-judge panel of the U.S. Court of Appeals for the Seventh Circuit Tuesday said the district court was wrong to dismiss the FMLA claims of James P. Breneisen Jr. and Anna Lineweaver.

The appellate court affirmed the rest of the lower court's dismissal.
