Consultants Get Longer Notice Period In Wells Fargo OT MDL

Law360, New York (May 17, 2013, 5:35 PM EDT) -- A Texas federal court extended a time window Friday for mortgage consultants to join multidistrict overtime litigation against Wells Fargo & Co. following the Fifth Circuit's ruling on an allegedly wasteful challenge to conditional certification, but didn't give the plaintiffs as much extra time as they wanted.

U.S. District Judge Gray H. Miller refused to extend the notice period from 90 to 180 days, which the plaintiffs ask him to do because of the “needless” delay caused by Wells Fargo's mandamus petition to the Fifth Circuit,...
