High Court's Atty Fee Ruling May Spur More Vaccine Claims

Law360, New York (May 20, 2013, 8:33 PM EDT) -- The U.S. Supreme Court ruled Monday that attorneys can still recover fees and costs for vaccine injury claims that a government compensation program determines to be time-barred, a decision that will make lawyers more likely to take calculated gambles on cases with timeliness concerns.

The ruling could cause a slight uptick in claims made to the government-funded National Vaccine Injury Compensation Program, which Congress established in 1986 to allow vaccine recipients to pursue injury claims while shielding vaccine makers from financially devastating jury verdicts.
