Fed. Circ. Nixes Anti-Dumping Duty Rate On Chinese Ribbon

Law360, New York (May 20, 2013, 5:50 PM EDT) -- The Federal Circuit on Monday vacated anti-dumping duties imposed by the U.S. Department of Commerce on Chinese ribbon imported by Yangzhou Bestpak Gifts & Crafts Co. Ltd., ruling that the agency's calculation was insufficiently supported by evidence.

The appeals court ruling overturned a U.S. Court of International Trade decision last year that found the 123.83 percent rate Commerce had applied to Bestpak to be “unfortunate” and “frustrating” but nonetheless “reasonable” under U.S. trade law.
