RJ Reynolds Attacks Engle Ruling In 11th Circ. Appeal

Law360, New York (May 21, 2013, 7:01 PM EDT) -- R.J. Reynolds Tobacco Co. told the Eleventh Circuit on Monday that the Florida Supreme Court was wrong to hold that the Engle tobacco litigation did not violate its due process rights, saying it mistakenly ruled that claims against the company could not be relitigated.

The tobacco company is appealing two judgments for plaintiffs in Engle suits at the federal level. The cases stem from the decertification of a class action by the Florida Supreme Court in 2006, in Engle v. Liggett Group Inc. The high court...
