Ashley Furniture Workers Denied Class Cert. Again In OT Row

Law360, New York (May 22, 2013, 6:26 PM EDT) -- A Pennsylvania federal judge on Wednesday refused for the second time to certify a class of current and former Ashley Furniture Industries Inc. employees who accuse the manufacturer of denying overtime wages, saying the workers lack commonalities for certification.

In August, U.S. District Judge Berle Schiller denied the plaintiffs' certification request, saying he needed to see additional information about the class allegations, but on Wednesday, the judge said the new information indicates that the employees lack commonalities for certification.
