Pa. Union Leaders Call Pension Overhaul Unconstitutional

Law360, Philadelphia (May 29, 2013, 2:19 PM EDT) -- Representatives from Pennsylvania public sector unions attacked Republican-sponsored legislation to shift public employees to 401(k)-style defined contribution retirement plans at a legislative hearing Wednesday, claiming the proposed changes violated the state’s constitution.

Top officials from the Pennsylvania State Education Association and Council 13 of the American Federation of State, County, and Municipal Employees told the Pennsylvania Senate Finance Committee that the Senate’s proposed legislation, along with a companion House bill, contradicts rulings that forbid any reductions to contractually owed pension contributions.
