PNC Bank Worker Loses Cert. Bid In Overtime Fight

Law360, Philadelphia (May 29, 2013, 5:32 PM EDT) -- A Pennsylvania federal judge on Wednesday refused to certify a class of assistant branch managers in a suit alleging PNC Bank NA wrongly denied them overtime pay, concluding there was no evidence to suggest 2,000 employees shared the same experience.

U.S. District Judge Terrence McVerry soundly rejected Victoria Moore’s arguments that the bank misclassified all ABMs as overtime exempt and willfully violated the Fair Labor Standards Act by failing to pay putative class members overtime for work exceeding 40 hours per week.
