10th Circ. Reverses Zimmer Win In Knee-Implant Injury Suit

Law360, New York (May 29, 2013, 5:52 PM EDT) -- The Tenth Circuit sent a personal injury suit against knee-implant maker Zimmer Holdings Inc. back to a lower court Wednesday, following the Oklahoma Supreme Court's ruling that medical device makers can be found negligent under state law for violating federal regulations.

The state's Supreme Court, in response to a question certified to it by the Tenth Circuit, held in March that the Federal Food, Drug and Cosmetic Act did not bar Oklahoma plaintiffs from bringing a negligence per se claim based on a violation of regulations...
