EEOC Asks 7th Circ. Whether Conciliation Can Be Reviewed

Law360, New York (May 31, 2013, 5:05 PM EDT) -- The U.S. Equal Employment Opportunity Commission on Thursday asked the Seventh Circuit to determine whether the agency's conciliation efforts are subject to judicial review in an appeal stemming from a lawsuit accusing Mach Mining LLC of bias against women in hiring.

The EEOC's petition requesting interlocutory review in its case against the coal mine operator asks the appeals court to decide not only whether courts can review the agency's informal bids to secure voluntary compliance through conciliation but also what kind of review would be warranted...
