El Paso Moves To Block Asarco Site Reopening

Law360, New York (January 22, 2008, 12:00 AM EST) -- The city of El Paso, Texas, has asked a bankruptcy judge to lift an automatic stay so that it can oppose Asarco LLC's bid for a permit to reopen a smelter site that the city says will emit severe amounts of pollution into nearby communities.

Relief from the stay would give El Paso the go-ahead to ask the Texas Commission on Environmental Quality to revoke Asarco's air permit, which allows the company to reopen a smelter site that has been shut for almost a decade, the...
