Walgreen Asks 8th Circ. To Settle Tracking Suit Venue Feud

Law360, Chicago (June 4, 2013, 10:07 PM EDT) -- Walgreen Co. on Monday urged the Eighth Circuit to keep in federal court a proposed class action accusing the drugstore chain of surreptitiously installing tracking software on consumers’ computers, claiming it did enough to show that the dispute involves more than $5 million.

The district court erred when it remanded the case to state court — where it was originally filed in April 2012 — on the basis that Walgreen failed to offer any evidence that the case met the $5 million threshold for federal jurisdiction...
