Sierra Club Sues BNSF Over Coal Spillage From Railcars

Law360, New York (June 5, 2013, 5:39 PM EDT) -- The Sierra Club and other environmental groups on Tuesday made good on their threat to sue BNSF Railway Co. for polluting Washington state waterways with coal by allegedly allowing ash to escape from railcars, launching a Clean Water Act suit in federal court.

The environmental groups are asking for $37,500 per day in Clean Water Act violations against BNSF and five coal companies that ship their coal on the railway, which could add up to more than $68 million for the five years of daily violations...
