2nd Circ. Rejects Delay Of OTC Morning-After Pill

Law360, New York (June 5, 2013, 7:10 PM EDT) -- The Second Circuit on Wednesday cleared the way at least temporarily for wider over-the-counter sales of Plan B emergency contraception, refusing to completely delay a New York federal judge’s demand for unfettered access.

In a brief order, the appeals court said the Obama administration had “failed to meet the requisite standard” for issuing a stay of an April court decision requiring the two-pill version of Plan B to be made available without a prescription or age limits.
