CMS Urges Court To Toss AHA's Inpatient Billing Suit

Law360, New York (June 7, 2013, 7:23 PM EDT) -- The Centers for Medicare and Medicaid Services on Thursday urged a Washington federal judge to dismiss an American Hospital Association suit challenging Medicare claim policies for denied hospital inpatient claims, saying the group had not exhausted its other available options.

According to CMS, the AHA and its fellow plaintiffs — five hospitals and hospital systems — are in the midst of both appealing their previously denied Medicare Part A inpatient claims and challenging the policy denying resubmission of those claims through available administrative channels, which precludes...
