9th Circ. Rejects Enviro Challenge To Calif. Timber Project

Law360, Los Angeles (June 13, 2013, 5:13 PM EDT) -- The Ninth Circuit on Thursday refused to block a logging project in California's Shasta-Trinity National Forest, affirming a ruling that found federal agencies had adequately reviewed the project's potential impacts on critical habitat of the endangered northern spotted owl.

Environmental group Conservation Congress had challenged the so-called Mudflow Project under the Endangered Species Act, objecting to the U.S. Forest Service and U.S. Fish and Wildlife Service's finding that the project would temporarily degrade 1,719 acres of the northern spotted owl’s suitable foraging habitat but was not...
