Judge Frowns At Insurer's Bid To Dodge Wrinkle Gel Coverage

Law360, Los Angeles (June 21, 2013, 7:45 PM EDT) -- Scottsdale Insurance Co. must fund Coapt Systems Inc.’s defense for 21 suits over its allegedly defective wrinkle-reducing skin fillers because the claims in the suits aren't excluded from coverage under Coapt's insurance policy, a California federal judge ruled Tuesday.

U.S. District Judge Maxine M. Chesney granted Coapt’s summary judgment motion seeking to compel Scottsdale to pay for the company's legal defense, saying Scottsdale failed to prove claims that Coapt made fraudulent transfers and caused physicians who used the product to lose money aren't covered in the insurance policy.
