Vital Can't Shed Redline Energy Drink Class Action

Law360, New York (June 21, 2013, 4:33 PM EDT) -- Vital Pharmaceuticals Inc. on Friday lost its bid to toss a proposed class action from a man who says he was hospitalized after drinking the company's Redline energy supplement, after a Florida federal judge said its arguments should be addressed later in the case.

U.S. District Judge William J. Zloch said the issues that Vital raised in its motion to dismiss would be better addressed in a motion for summary judgment after both sides have conducted discovery, and denied the company's motion.

Mirabella launched his lawsuit in October alleging the drink can cause chills, vomiting, convulsions, chest pain and rapid heartbeat....
