Supreme Court To Weigh NLRB Recess Appointments

Law360, New York (June 24, 2013, 10:25 AM EDT) -- The U.S. Supreme Court agreed Monday to review a D.C. Circuit ruling that invalidated the president's recess appointments to the National Labor Relations Board as unconstitutional, setting the stage for a major constitutional test of the executive branch's power. 

Both the NLRB and Noel Canning, the Noel Corp. unit whose challenge to an adverse board decision led to the D.C. Circuit's ruling, had urged the high court to accept the case for review, and the justices were widely expected to take the case.
