Forum Clause Sank Brown Rudnick Suit Only In NJ: Judge

Law360, New York (June 25, 2013, 8:29 PM EDT) -- A New Jersey federal judge on Tuesday gave life to Surgical Orthomedics Inc.'s malpractice claims against Brown Rudnick LLP, saying her dismissal of SOI's suit regarding a $3.3 million arbitration award was based on a forum selection clause limiting legal action to New York.

U.S. District Judge Esther Salas clarified that in granting Brown Rudnick's motion for dismissal with prejudice on June 21, she did so due to the forum selection clause between the parties and not the underlying merits of the suit. The order was...
