Chevron's Dismissal Bid In 'Hot Fuel' MDL Falls Short

Law360, Los Angeles (June 28, 2013, 7:29 PM EDT) -- A Kansas federal judge refused Friday to dismiss a class action alleging Chevron USA Inc. sold gas in California without accounting for temperature expansion, saying that an earlier settlement in the case does not eliminate the court's jurisdiction.

U.S. District Judge Kathryn H. Vratil declined to dismiss the case under the home-state exception to the Class Action Fairness Act, saying that the court still has minimal diversity jurisdiction even though Washington-based Costco, the only defendant based outside of California, settled with the plaintiffs last year....
