2nd Circ. Kills Buffalo Firefighters’ Race Bias Suit

Law360, New York (July 1, 2013, 6:56 PM EDT) -- The Second Circuit on Monday refused to reopen a race bias suit brought by black Buffalo, N.Y., firefighters who claim the city’s drug testing policy was unfair, ruling that their evidence of discrimination was too thin.

A three-judge panel said the firefighters had not shown that the city actually treated them worse than similar white firefighters.
