Court Nixes J&J's Bid To Toss Stent Patent Suits

Law360, New York (January 29, 2008, 12:00 AM EST) -- A Delaware federal judge has refused to dismiss or transfer four Boston Scientific Corp. lawsuits that seek to invalidate Johnson & Johnson patents for drug-eluting coronary stents.

U.S. Judge Sue L. Robinson of the U.S. District Court for the District of Delaware denied J&J's motions to dismiss the cases on Thursday.

She ruled that the court has jurisdiction over the declaratory judgment claims even though the Boston Scientific stents which may infringe J&J's patents have not yet been approved by the U.S. Food and Drug Administration....
