NJ Court Says ERISA Preempts Hospital's Payment Claims

Law360, New York (July 2, 2013, 6:51 PM EDT) -- A New Jersey hospital's state law claims that a benefit plan owes it full price for medical services after failing to timely pay discounted fees are trumped by the federal Employee Retirement Income Security Act, a state appellate court ruled Tuesday in a published decision.
