Quest Shareholders Can't Have Protected Docs In $3M Fee Bid

Law360, Wilmington (July 3, 2013, 8:11 PM EDT) -- A Delaware Chancery judge Wednesday denied a request by Quest Software Inc. shareholders to access confidential documents in a bid to be awarded nearly $3 million in legal fees, after suing to challenge a scrubbed $2 billion private equity buyout of the company.

Vice Chancellor Sam Glasscock III ruled that the shareholders hadn’t convinced him that the documents were either injected into the litigation by the Quest defendants, or shared with a third party outside of the case, and thus no longer protected by attorney-client privilege....
