Appeals Court OKs Extension Of Insurer's Noncompete Deal

Law360, Dallas (July 8, 2013, 5:26 PM EDT) -- A Texas appeals court on Wednesday held that an arbitrator had the power to grant a one-year extension of a noncompete agreement barring insurance executives who left Nationsbuilders Insurance Services Inc. from launching a rival insurer.

Reversing the trial court, the Dallas Court of Appeals said the arbitrator had the authority to grant Nationsbuilders the extension as an equitable remedy after ex-employees Kevin Cunningham and Michael Leamanczyk began marketing and planning a competing business within the original one-year competition restriction, though they did not actually sell...
