1st Circ. Affirms Airlines' Victory In Skycaps Dispute

Law360, New York (July 10, 2013, 7:57 PM EDT) -- The First Circuit on Tuesday ruled that the Airline Deregulation Act preempts common law claims in two consolidated class suits brought by United Airlines Inc. and U.S. Airways Inc. skycaps challenging the companies’ implementation of a $2 bag checking fee.

A three judge panel affirmed a lower court decision finding that the ADA preempts the skycaps’ common law actions for unjust enrichment and tortious interference based on the airlines' imposition of the fees.
