Hospital Group Ducks Revival Of FCA Case Lacking New Facts

Law360, New York (July 10, 2013, 8:03 PM EDT) -- A Florida federal judge refused Wednesday to reconsider his latest dismissal of a whistleblower lawsuit accusing hospital group Health Management Associates Inc. of paying kickbacks to doctors in violation of the False Claims Act, saying the suit had no new facts.

U.S. District Judge John E. Steele said that no new law had arisen since his March 19 dismissal of former HMA employee J. Michael Mastej's third amended complaint and that Mastej's daily review of hospital reports "cannot be said to be 'new' evidence."
