Mylan Failed To Prove Identical Ingredients: Abbott Suit

Law360 (November 22, 2005, 12:00 AM EST) -- Generic drug maker Mylan Pharmaceuticals Inc. failed to show the active ingredients in its version of epilepsy drug Depakote are identical to Abbott Laboratories’ original version as required by U.S. Code, according to a federal patent infringement lawsuit filed by Abbott recently.

Illinois-based Abbott sued West Virginia-based Mylan in response to Mylan’s amended Abbreviated New Drug Application filed with the U.S. Food and Drug Administration in October. The suit was filed in U.S. District Court for the Northern District of Illinois.
