DuPont Urges Fed. Circ. To Reverse $1M Sanction In IP Row

Law360, Los Angeles (July 11, 2013, 1:31 PM EDT) -- DuPont Co. pressed the Federal Circuit on Monday to vacate $1 million in sanctions imposed on it for allegedly lying during patent litigation with Monsanto Co., arguing that the purported fraud committed was merely argument supported by a “reasonable interpretation” of the evidence.

In a 121-page opening appellate brief, DuPont stated that its arguments during the course of patent infringement litigation with Monsanto about its own “stacking” rights to herbicide-resistant seeds as part of the companies’ 2002 licensing agreement had a basis in fact and law....
