Mass. High Court Limits Title Insurers' Duties

Law360, New York (July 11, 2013, 5:41 PM EDT) -- The Massachusetts Supreme Court dramatically narrowed the defense obligations of title insurers Thursday, while saving First American Title Insurance Co. from covering a lawsuit accusing Deutsche Bank NA and others of a predatory lending scheme.

Upholding First American's win at the trial court level, the state high court ruled that title insurers only have a duty to defend when their policies specifically envision the type of loss alleged in an underlying suit.
