NLRB Says 6th Circ. Ruling Backs Its Stance In Quorum Row

Law360, New York (July 12, 2013, 6:34 PM EDT) -- The National Labor Relations Board told the Third Circuit on Thursday that a recent Sixth Circuit opinion finding challenges to recess appointments nonjurisdictional supports the board's bid for a rehearing in a case that invalidated Craig Becker's appointment to the board.

The NLRB's pending rehearing petition takes aim at a 2-1 Third Circuit panel opinion from May 16 that struck down an August 2011 ruling issued by Becker and two other then-board members finding that New Vista Nursing & Rehabilitation had committed an unfair labor practice...
