NY Times Reporter Can't Protect CIA Leak, 4th Circ. Says

Law360, New York (July 19, 2013, 2:39 PM EDT) -- The Fourth Circuit on Friday said a New York Times reporter will have to say whether ex-CIA official Jeffrey Sterling was his source for confidential information on an operation to disrupt Iran's nuclear weapons program, finding that the reporter is the only tenable authority on the leaks.

The decision reverses a Virginia federal court's 2011 ruling that reporter James Risen could protect the anonymous source. The Fourth Circuit relied on the Supreme Court's rejection of reporter's privilege in criminal cases and the lack of federal law...
