Army Corps Beats Suit Over $791M Fla. Airport Project

Law360, Los Angeles (July 22, 2013, 6:49 PM EDT) -- A Florida federal judge on Monday granted summary judgment to the U.S. Army Corps of Engineers in a suit accusing it of failing to consider noise levels and ignoring a cheaper alternative when it approved a land-use permit for Fort Lauderdale airport's $791 million runway expansion.

In a 25-page decision, U.S. District Judge James I. Cohn ruled the Corps did not violate the National Environmental Policy Act because it “took a hard look at the environmental consequences of issuing the permit.”
