HHS Can Delegate Overpayment Screening, DC Circ. Says

Law360, New York (July 23, 2013, 7:16 PM EDT) -- The D.C. Circuit ruled Tuesday that Medicare contractors can decide when to use statistical sampling to estimate a health care provider's allegedly improper reimbursements, nixing arguments that such determinations can only come from the U.S. Department of Health and Human Services itself.

The appeals court turned down home health services giant Gentiva Healthcare Corp.'s appeal of an administrative ruling that found it owed $2.1 million in Medicare overpayments, a conclusion that rested on a review of its reimbursement claims by Medicare contractor Cahaba Safeguard Administrators LLC....
