Cos. Need New FTC Disgorgement Rules, Wright Says

Law360, New York (July 25, 2013, 5:06 PM EDT) -- Commissioner Joshua Wright last week criticized the Federal Trade Commission's recent decision to "clandestinely" pull its policy statement explaining when it would seek disgorgement in antitrust cases, saying that companies needed guidance to run their businesses.

Though Wright had not yet joined the FTC when it decided to revoke its nine-year-old statement laying out when it believed monetary remedies were appropriate in competition cases, in a July 19 speech he applauded fellow Republican Commissioner Maureen Ohlhausen's dissent from the decision.
