7 Cases In Darvocet MDL Sent Back To State Court

Law360, New York (July 26, 2013, 2:25 PM EDT) -- A Kentucky federal judge on Thursday remanded seven cases in multidistrict litigation alleging McKesson Corp. and other companies didn’t properly warn consumers about risks associated with painkillers Darvocet and Darvon, finding the claims do not depend upon a question of federal law.

U.S. District Judge Danny C. Reeves said McKesson and the other pharmaceutical companies failed to meet their burden to demonstrate that federal jurisdiction is proper under the Class Action Fairness Act, and granted the plaintiffs' motion to remand all seven cases. Judge Reeves also...
