Appeals Court OKs $2.7M Royalty Verdict Against Biomet Units

Law360, New York (July 30, 2013, 8:05 PM EDT) -- The New Jersey Appellate Division on Tuesday backed a nearly $2.7 million jury verdict for a spine surgeon who accused Biomet Inc. subsidiaries of breaching an agreement that provided annual, $250,000 royalty payments for his work developing products.

Dr. Neil Kahanovitz disagreed with Electro-Biology Inc. and EBI LLC that a 2004 consulting agreement halted those payments after Nov. 30, 2008, instead claiming that the deal envisioned ongoing payments as long as he remained a practicing orthopedic surgeon.
