Class Challenges $300M Monsanto Toxic Tort Settlement

Law360, Los Angeles (July 30, 2013, 10:18 PM EDT) -- A group of more than 200 plaintiffs who claim they were exposed to toxic chemicals dumped by Monsanto Co. challenged Tuesday a judge's 2003 approval of a $300 million settlement in a mass tort against Monsanto, saying their interests weren't represented in that case because they weren't involved in any phase of the litigation.

In a proposed class action filed Tuesday, the plaintiffs said an Alabama federal judge who approved settlement in the original mass tort, a case called Tolbert v. Monsanto, lacked personal or subject matter jurisdiction at the time he entered the judgment. The 271 plaintiffs claimed they are among 7,169 people...
