11th Circ. Won't Reduce Medicare Fraudsters' Sentences

Law360, New York (July 31, 2013, 7:08 PM EDT) -- The Eleventh Circuit on Wednesday upheld the convictions of two former rehabilitation center directors in a Medicare kickback scheme, saying the duo's guilty pleas do not entitle them to a sentencing reduction because they failed to accept full responsibility.

Jorge Luis Reyes and Waldo Gonzalez, who were each sentenced in September to 10 years imprisonment for the kickback scheme they ran through Florida-based W&J Rehabilitation Center, said a district court shouldn't have sentenced them to the statutory maximum since they pled guilty, but a three-judge panel...
