Expert's Misdeed Shouldn't Sink Toyota Suit, Conn. Court Says

Law360, New York (August 1, 2013, 6:06 PM EDT) -- The Connecticut Supreme Court ruled Thursday that a trial court was wrong to effectively dismiss a personal injury lawsuit against a Toyota Motor Corp. unit over a plaintiffs expert's misrepresentations, saying it should have imposed a less severe penalty.

The suit centers on injuries sustained by plaintiff Emilio D'Ascanio that were allegedly caused by a defective forklift designed, made and distributed by defendants Toyota Material Handling USA Inc., BT Prime Mover Inc. and Summit Handling Systems Inc. D'Ascanio's wife is also a plaintiff in the suit....
