2nd Circ. Nixes Russian Co.'s Suit Over Stoli Trademark

Law360, New York (August 5, 2013, 7:36 PM EDT) -- The Second Circuit on Monday affirmed the dismissal of a lawsuit over the Stolichnaya trademark, finding that a Russian state-owned company lacked standing to challenge use of the mark in the U.S.

A three-judge panel said that Federal Treasury Enterprise Sojuzplodoimport, a government company that under Russian law has some authority over the popular vodka’s trademark, did not have standing to represent the Russian Federation in a U.S. lawsuit.

The decision affirms a September 2011 ruling by U.S. District Judge George B. Daniels.
