Marketing Co. Dodges TCPA Text Spamming Class Suit

Law360, New York (August 5, 2013, 3:24 PM EDT) -- A Florida federal judge Monday dismissed class allegations that text message marketer Club Texting Inc. violated the Telephone Consumer Protection Act by sending unsolicited texts to consumers, finding that he had no jurisdiction over the company.

Plaintiff Shaina Rutherford said in her class action complaint that Club Texting Inc., doing business as EZ Texting Inc., violated the TCPA by making unsolicited texts on behalf of Zoom Tan LLC, Zoom Tan Inc. and Zoom Tan Franchising LLC.
