6th Circ. Delivers Win To Life Insurance Co. In ERISA Row

Law360, Los Angeles (August 5, 2013, 9:45 PM EDT) -- The Sixth Circuit rejected a mailworker’s claim that Life Insurance Company of North America improperly denied her benefits when a back injury kept her from work, according to a published opinion issued Monday.

Mailworker Kimberly Frazier accused LINA of violating the Employee Retirement Income Security Act by improperly reviewing her claim for long-term disability, saying it neglected to conduct a physical examination of her and didn’t consider enough medical evidence of her injuries, according to a lawsuit filed in Kentucky federal court in February 2011....
