Landowners Lose Class Cert. Bid In Oil, Gas Royalties Suit

Law360, New York (August 5, 2013, 8:36 PM EDT) -- Landowners who say Energy Corp. of America bilked them of oil and gas lease royalties took a hit in Pennsylvania federal court Monday, when a magistrate judge refused to recommend class certification for their suit.

U.S. Magistrate Judge Robert C. Mitchell recommended denying the certification, saying the landowners hadn't properly proved the class would exceed 40 members and have common claims, nor that the plaintiffs would be typical of the class.
