6th Circ. Says FedEx Can't Shorten Time Limit On FLSA Claims

Law360, New York (August 6, 2013, 4:58 PM EDT) -- The Sixth Circuit on Tuesday reinstated overtime and equal pay claims that were brought by a FedEx employee within the statutory time limit but not within a six-month limit mandated by her employment agreement, saying such claims cannot be waived.

A Tennessee federal court had dismissed Margaret Boaz's Fair Labor Standards Act and Equal Pay Act suit against FedEx as time-barred because she failed to bring it within the six-month limit, even though they were brought within the laws' multiyear time limit. But the appeals court...
